Terms & Conditions
 

1. Definitions

1.1 "Prestige Details" is a trading name of Foleys Automotive. Any reference to "we," "us," or "our" in these terms and conditions refers to Foleys Automotive Ltd, trading as Prestige Details.
1.2 "You," "your," or "Client" refers to the individual or entity booking our services, whether on behalf of yourself or a third party.
1.3 "Services" refers to any detailing, valeting, paint protection, or related work provided by us.
1.4 "Vehicle" refers to any car, van, commercial vehicle, motorcycle, caravan, or any other form of transport accepted by us for cleaning.
1.5 "Booking" refers to any appointment or agreement made by you for our services, whether confirmed verbally, in writing, or via our online booking system.
1.6 "Premises" refers to any location where we provide services, whether at our facility or a mobile service location.

2. Booking & Cancellations

2.1 Booking Confirmation: All bookings are subject to availability. By booking our services, you agree to these Terms & Conditions.
2.2 Weather & Cancellation Policy:

  • We reserve the right to cancel or reschedule bookings due to adverse weather conditions (e.g., heavy rain, freezing temperatures, extreme heat). We will provide as much notice as possible.

  • Cancellations by you must be made with at least 48 hours' notice to avoid charges.

  • Cancellations within 48 hours but over 24 hours before the booking will incur a 25% charge of the booking value.

  • Cancellations within 24 hours of the booking will incur a 50% charge of the booking value.

  • If we arrive at the booking location and are unable to access the vehicle or carry out the service due to reasons beyond our control, the cancellation charge will apply.

3. Pricing & Payment

3.1 Quotations & Price Adjustments:

  • All prices quoted include travel within a 15-mile radius of the BH6 postcode. Travel beyond this incurs an additional fee of £22.50 per 30 minutes or £45.00 per hour, booked in 30-minute increments.

  • Prices given over the phone or online are estimates and may be adjusted upon physical inspection of the vehicle.
    3.2 Payment Terms:

  • Payment is required in full upon completion of the service.

  • We accept cash or bank transfer.

  • Business clients receiving invoices must pay immediately upon receipt; no credit terms are implied.
    3.3 Late Payments:

  • Invoices unpaid for over 30 days will incur a £40.00 late payment fee (for invoices under £1,000) under the Late Payment of Commercial Debts (Interest) Act 1998.

  • Interest of 8% above the Bank of England base rate will be applied when the invoice becomes overdue.

4. Vehicle Condition & Liability

4.1 Empty Vehicle Policy:

  • Vehicles must be emptied of all personal or commercial items before interior services begin.

  • If items remain inside, we reserve the right to:

    1. Reduce the cleaning time allocated.

    2. Leave certain compartments unfinished.

    3. Charge a £20.00 surcharge for additional time spent removing items.

  • We are not liable for any misplaced or lost items.
    4.2 Odour Removal Policy:

  • We do not guarantee complete odour removal. No refunds will be issued for odour-related concerns.
    4.3 Services We Do Not Offer:

  • We will not clean milk spillages, oil/chemical spills, blood, vomit, bio-waste, or excrement.

  • If a client fails to disclose such conditions in advance, the service will be canceled, and the full cancellation fee will apply.
    4.4 Damage Liability:

  • We are not liable for any pre-existing defects, scratches, paint damage, or weaknesses that worsen during the detailing process.

  • If your vehicle has paint protection film (PPF), wraps, or aftermarket coatings, we are not responsible for any issues arising from detailing.

5. Use of Products & Equipment

5.1 Product Substitution:

  • We reserve the right to change or upgrade products at any time to improve service quality.
    5.2 Child Seats & Accessories:

  • If a child seat is left in the vehicle, we may remove it to clean underneath. It is your responsibility to reinstall and secure the seat properly. We will not be liable for injury due to improper reinstallation.

6. Photos & Videos

6.1 Promotional Use:

  • We may take before-and-after photos or videos of vehicles for promotional purposes on social media or our website.

  • If you do not wish for your vehicle to be used in promotional content, you must inform us before the service begins.
    6.2 Client Privacy:

  • We respect our clients' privacy and will never disclose personal information, including addresses, house numbers, or other private details in social media posts.

7. Complaints & Refunds

7.1 Complaints Procedure:

  • If you are dissatisfied with our service, you must report the issue:

    • Within 24 hours if you were present during handover.

    • Within 48 hours if you were not present at handover.

  • Complaints must be made via phone (07570 236376) or email (hello@foleysautomotive.co.uk).

  • We must be allowed the opportunity to inspect and rectify the issue.
    7.2 Refunds:

  • Refunds are only considered if we are given the chance to fix any issue first.

  • Partial refunds may be issued for specific service deficiencies (e.g., incomplete paint protection).

  • No refunds will be issued if the vehicle has been used extensively after service and the issue is no longer verifiable.

8. Legal & Liability

8.1 Insurance & Risk:

  • Your vehicle remains your responsibility at all times. We are not responsible for theft, loss, or damage while your vehicle is on our premises or in our care.
    8.2 Illegal Substances:

  • If we find illegal substances or items in your vehicle, we will terminate the service and notify the authorities. No refund will be issued.
    8.3 Force Majeure:

  • We are not responsible for delays or cancellations due to uncontrollable events (e.g., severe weather, accidents, power outages).

9. Agreement to Terms

9.1 By booking a service with us, you confirm that you have read, understood, and agree to these Terms & Conditions.
9.2 A link to these Terms & Conditions is included in all booking confirmations.

10. Governing Law

10.1 These Terms & Conditions are governed by English law, and any disputes shall be settled in the courts of England.
